Nibble Chocolate takes food safety, quality, and regulatory compliance seriously. We work with approved suppliers and review our products and processes against applicable requirements of California’s Safe Drinking Water and Toxic Enforcement Act of 1986, commonly known as Proposition 65.

Cocoa and other agricultural ingredients can contain naturally occurring trace amounts of elements such as cadmium and lead. Their levels can vary based on soil, growing region, agricultural practices, and processing.

What a Proposition 65 warning means

Proposition 65 requires a warning when a product can expose a California consumer to a listed chemical at a level that requires one. Whether a warning is required depends on the specific chemical, the amount of exposure, applicable safe-harbor levels, and any legally available exemption. The “naturally occurring” provision is fact-specific and is not an automatic exemption for every trace amount found in food.

Where required, Nibble provides a California Proposition 65 warning on the product label, packaging, and/or online product page, as applicable. A warning does not mean that a product violates a safety standard; it is intended to inform California consumers about potential exposure to a listed chemical.
